Safeguarding the legitimate rights and interests of all residents and strengthening the decoration management of residential quarters

The Regulations on the Decoration and Renovation Management of Residential Quarters in Lianyungang City (hereinafter referred to as the Regulations), which will come into effect on May 1, will focus on strengthening the decoration and renovation management of residential quarters, safeguarding public safety and public interests, creating a livable living environment and safeguarding the legitimate rights and interests of all residents.

The "Regulations" stipulate that if the decorator entrusts the decoration contractor to undertake the decoration project, it shall sign a written contract. Before the decoration project starts, the decorator shall go through the registration formalities with the realty service enterprise with relevant information, and sign the decoration management service agreement and the corresponding written commitment letter. To change the main building or load-bearing structure, it is necessary to submit the design proposal put forward by the original design unit and the examination and approval opinions issued by the urban housing safety appraisal institution, and go through the approval procedures in accordance with the regulations. In residential areas without property services, the decorator shall inform the village (neighborhood) committee in advance before the decoration activities.

The "Regulations" emphasize that in the decoration activities of residential quarters, it is strictly forbidden to implement acts that affect the building structure and production safety. For example, arbitrarily changing the building main body and load-bearing structure such as building floor, wall and support; Changing rooms or balconies without waterproof requirements into bathrooms and kitchens in violation of waterproof standards; Through the layer, dig down to expand the use space or change the original appearance design; Demolition of brick and concrete walls connecting balconies; Dismantle the floor thermal insulation and sound insulation system without authorization; Damage to public energy-saving facilities and barrier-free facilities in residential quarters; Occupation of public space or damage to public parts and facilities in residential quarters, which affects the structure or use safety of buildings and structures in residential quarters.

In order to safeguard the legitimate rights and interests of other residents in residential areas, the Regulations stipulate that decorators should post public signs in prominent positions and decoration sites in residential areas, and publicly disclose information such as the telephone number, construction time, supervision unit and supervision method of the decorators and the person in charge of the construction party. At the same time, effective measures should be taken to prevent or reduce the harm and pollution caused by waste gas, waste water, dust, vibration, noise, solid waste and construction lighting. It is forbidden to carry out decoration activities that generate noise in residential quarters from 12: 00 to 14: 00, from 19: 00 to 8: 00 the next day, and on legal rest days, holidays, senior high school entrance examination days and college entrance examination days. If decoration activities are carried out at other times, effective measures should be taken to avoid or reduce noise pollution to surrounding residents.

According to the "Regulations", the housing and urban-rural construction department of Lianyungang will establish a supervision information platform for the decoration and renovation of residential quarters, and implement dynamic supervision on the decoration and renovation projects of residential quarters. Any unit or individual has the right to complain and report any illegal act in the decoration of residential quarters.

Focus on the implementation of spot check measures to curb illegal decoration behavior

Recently, the Housing and Urban-Rural Development Bureau of Changsha City organized the supervision of the safety management of existing houses in the first quarter of this year, and at the same time, conducted key spot checks on the implementation of "Several Measures for Strengthening the Safety Management of Interior Decoration and Decoration of Urban Houses in Changsha City" (hereinafter referred to as "Several Measures"), so as to find, stop and rectify early, and resolutely curb illegal decoration and decoration behaviors.

In order to further standardize the indoor decoration and put an end to the problem of "barbaric decoration" such as privately demolishing load-bearing walls, Changsha Housing and Urban-Rural Development Bureau issued "Several Measures" in February this year, requiring decoration and decoration projects (limited to non-residential projects) with a project investment of more than 300,000 yuan and a construction area of more than 300 square meters to apply for a construction permit from the housing and urban-rural construction department of the county (city) where the house is located before starting. No decoration works without a construction permit shall be started. At the same time, strict management measures are implemented for decoration projects with an investment of less than 300,000 yuan or a building area of less than 300 square meters, including strict implementation of the declaration and registration system, strict implementation of the normal inspection system, strict safety management of the construction site, strict implementation of supervision and inspection requirements, strict implementation of joint punishment, and strict enforcement of linkage.

The "Several Measures" require strict implementation of the declaration and registration system, and require property management units to inform the prohibited behaviors and precautions of decoration projects in writing. If the decorator fails to inform in advance and sign the decoration management service agreement and commitment letter, the property management unit will restrict the construction personnel and materials from entering the construction site according to the community statute.

Strictly implement the normal inspection system. Has handled the decoration project registration procedures, the property management unit should promptly publicize the decoration project in the residential building. The property management unit shall strengthen the normal inspection of the decoration site according to the relevant regulations, record the inspection situation in detail, and form the inspection account. Found illegal behavior, should immediately discourage, stop and urge to correct, to refuse to correct, timely report to the community, and step by step report to the relevant administrative departments of towns, streets or territories.

The "Several Measures" require that the safety management of the construction site be strictly strengthened, and it is forbidden to carry out acts that affect the main body and load-bearing structure of the building, and it is forbidden to change the area, structure and use of the originally designed room. If the floor load is increased beyond the design standards or specifications, the construction shall not be carried out without the original design unit or the design unit with corresponding qualification grade. At the same time, strictly strengthen joint law enforcement, and those who hinder law enforcement, refuse to cooperate with law enforcement and refuse to restore the changed building main body and load-bearing structure shall be promptly submitted to the local public security organs for punishment according to the Law of People’s Republic of China (PRC) on Public Security Administration Punishment. Unauthorized changes to the main body and load-bearing structure of the building, causing major security risks endangering public safety and suspected of constituting a crime, shall be transferred to the local public security organs for legal treatment.
